My client, with the assistance of my investigators, and after planning and having discussions with myself, entered into a daycare facility and took his child. The police, FBI and others were contacted immediately, with the mother screaming that the child had been kidnapped. The news reports were scathing. I contacted a local television anchor and told him to get me on the news. He did, and I explained that the mother had no contact with the child for years; that the mother essentially removed the child from the father and hid his son from him for months. I explained that the father’s actions were justified. My investigator and I were contacted by the police. We were sure criminal allegations were going to be filed against us for kidnapping. The end result was that the father received custody and all criminal charges were dismissed.
His defense team accused my client, the babysitter, of killing the child. Even though my client hadn’t done anything, I would not allow her to testify without receiving immunity. The case eventually went to the U.S. Supreme Court, which agreed with me that my client was entitled to receive immunity from prosecution.
A guilty verdict would have resulted in his being fired from the police force. He was found not guilty after a two-day trial.
The mother took off with the child and was gone for about 5 years. We eventually found her in Alaska. Even though my client hadn’t seen his child in 5 years, I was able to convince the court that the father should have custody. Today, father and son are doing great.
She came to me with thousands of dollars of counterfeit bills her husband made. Her husband also was found to have made illegal silencers. He was subsequently arrested. While in jail, the husband tried to hire a hit man to kill my client and myself. Fortunately, the plot was compromised and the man is in federal prison.
I had never been to this county before, but made inquiries as to his wife’s attorney. Based on information my client provided to me, I was instrumental in having a federal lawsuit filed against my client’s wife and her attorney for illegal wiretapping. I was able to save my client almost $200,000 in his divorce settlement as a result of my actions.
The case was very challenging and interesting, based on the science and expertise that were presented at trial. We prepared a computer simulation of the bar to show “lines of sight”, as far as what witnesses could or could not see. We presented the testimony of a lighting expert to attack the eyewitness’ accounts. We presented the testimony of a memory expert to demonstrate the inaccuracies of eyewitness testimony.
