Burglary is a theft crime with extreme penalties. If you have been charged with this serious crime, you need a skilled Toledo burglary attorney to fight for you. Lorin J. Zaner has a reputation for results, and have been dedicated to criminal defense for over 40 years.

WHAT ARE THE PENALTIES FOR BURGLARY CHARGES?

Because burglary involves both trespassing and theft crimes, a conviction can mean extremely severe penalties. Ohio law breaks burglary charges into a handful of categories, each with a different level of penalties. All burglary charges are considered felonies and include:
  • Breaking and Entering: You will face this charge for entering an unoccupied structure with the intent to commit theft or any other felony. The penalties include 6 to 12 months in prison and up to $2,500 in fines.
  • Burglary: You can be charged in the 2nd, 3rd, or 4th degree depending on the circumstances. Increased prison sentences and fines will occur if you trespassed with the intent to commit any criminal offense or if the structure was occupied. Depending on these factors, the penalties can include 6 months to 8 years in prison and anywhere from $5,000 to $15,000 in fines.
  • Aggravated Burglary: You will face this charge for entering an occupied structure with the intent to commit theft or any other felony and you had a deadly weapon or you attempted, threatened, or inflicted physical harm on another person. The penalties for this charge include 3 to 10 years in prison and up to $20,000 in fines.
